Terms and conditions
Proofs, timings, payment and your consumer guarantees: the rules for every order.
About these terms
These terms govern orders for personalised fans placed with LING GROUP LLC, trading as Wedding Fans, by consumers or businesses. The seller's details appear in the legal notice. Approving and paying for a proof means you accept these terms, which you can read and save on this page at any time.
The approved proof and the payment receipt are sent to you by email and serve as the record of your order.
Nothing in these terms excludes, restricts or modifies the rights you have under the Australian Consumer Law, set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), or any other law that cannot be excluded.
Products
Our fans are folding fans with bamboo sticks and a paper or fabric leaf, printed in one ink colour according to the design chosen, the names, date and text provided by the customer, and the options selected (engraving, tassel, cord, packaging).
Previews, photos and colours shown on the website are for illustration only: a screen cannot reproduce the exact shades of fabrics, papers and inks. The approved proof and the quote prevail.
Prices
Prices are shown in Australian dollars, excluding GST. The price shown by the designer reflects the quantity, design and options chosen at the time of the request; it is carried over unchanged to the proof and changes only if the customer changes the quantity, design or options. Shipping is added according to quantity: the amount appears in the designer's total breakdown, then on the proof. GST and any import charges are confirmed with the proof, before you approve and pay, so you know the full amount payable. The minimum order is 50 fans.
Requests, proofs and orders
The customer designs a fan on the website, or describes a bespoke request through the form, by email or by message. A free proof is sent within 24 business hours, with two rounds of changes included; beyond that, we discuss it before charging anything. Nothing is made before the proof is approved in writing and payment is received.
The customer checks the proof for the spelling of the names, the date, the text and the colours. Fans printed exactly as shown on an approved proof match their description: an error that appears on the approved proof does not entitle the customer to a free replacement.
The customer confirms that they hold the rights to any logos, artwork and text they ask us to print, and that this content does not infringe anyone else's rights.
Payment
The customer can pay online when placing the request, by card through Stripe, or after approving the proof, by card (secure payment link) or bank transfer. In every case, production starts only after the proof is approved in writing and payment is received.
Timings and shipping
Production and shipping times are shown on the website and on the proof, and run from approval and payment. They are estimates, and the delivery date is checked with you before you pay. Delivery is made to the address given by the customer, and the fans are your responsibility once they have been delivered to you. We recommend ordering at least six weeks before the wedding date.
On receipt, please let us know about any damage or missing items as soon as you can, ideally within 48 hours and with photos, so that we can put things right before the wedding. This does not affect your rights under the Australian Consumer Law.
Cancellation and change of mind
A request can be cancelled at no cost as long as the proof has not been approved. If you have already paid online, the amount paid is then refunded in full.
Our fans are made to your specifications and personalised with your names and choices, so they cannot be sold to anyone else. For this reason, once the proof has been approved and production has started, we do not offer refunds or exchanges for a simple change of mind. This does not affect your rights if the fans have a problem covered by the consumer guarantees below.
Your consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Among other things, the fans must be of acceptable quality, fit for the purpose you made known to us, and match their description, which here means matching the approved proof. Because every fan is made for you, where the law gives us the choice of remedy, we replace or refund rather than repair.
To make a claim, write to us with your order reference and photos of the problem.
Claims: [email protected]
by phone or WhatsApp on +44 7488 845524.
If we cannot resolve a problem together, you can contact the consumer protection agency (fair trading or consumer affairs office) of your state or territory.
Our responsibility
If we do not meet these terms, we are responsible for loss or damage you suffer that is a reasonably foreseeable result of our failure. We are not responsible for differences in appearance inherent to printing techniques and materials, nor for errors that appear on an approved proof. We do not exclude or limit any liability that the law, including the Australian Consumer Law, does not allow us to exclude or limit.
For business customers, and only to the extent permitted by law, our total liability is limited to the amount paid for the order concerned, and we are not liable for indirect or consequential loss or for loss of profit.
Governing law
For customers in Australia, these terms are governed by the laws in force in Australia, including the Australian Consumer Law. If you are a consumer, you can bring proceedings in the courts of the state or territory where you live.
